Can married adult daughter claim maintenance for elderly father legally?

Can a married adult daughter, who has two sons and a husband, claim maintenance for her elderly father under the Hindu Adoption and Maintenance Act?

Dear Client, Yes, a married adult daughter can be legally obliged to maintain her elderly father under HAMA, 1956 (Hindu Adoptions and Maintenance Act), on the condition that she has sufficient means and her father is unable to maintain himself. (see section 20(1)) In addition, there is also a secular law governing this. The Maintenance and Welfare of Parents and Senior Citizens Act, 2007, provides that children are legally bound to maintain their elderly father when he is unable to maintain himself. Under Section 20 of the Hindu Adoption and Maintenance Act, 1956, a married adult daughter can be held liable to pay maintenance to her elderly father if he (father) is unable to maintain himself.

A married adult daughter can be legally liable to maintain her elderly father under Section 20 of the Hindu Adoption and Maintenance Act, 1956 (HAMA) but only if the father is unable to maintain himself and has no sufficient means, and the marital family of the daughter is financially stable enough.
