How the amount of alimony is decided in divorce case?

A Hindu husband earns ₹30,000 per month and lives in his parents’ house. The wife is unemployed, less educated, and there are no children. After 7 years of marriage, in a mutual divorce, what could be the maximum reasonable one-time lump-sum alimony/settlement payable to the wife?

There is no fixed maximum limit for one-time settlement. Courts consider the husband’s income, wife’s needs, duration of marriage, and standard of living. With an income of ₹30,000 per month and no major assets, a very high lump-sum amount may not be reasonable. Usually, settlement is negotiated around a figure equivalent to a few years of reasonable maintenance. It is best to arrive at a mutually acceptable amount through negotiation or mediation and record it clearly in the mutual divorce agreement to avoid future claims.
