A 50-year-old Hindu man and a 50-year-old Muslim woman, both divorced from their previous marriages, wish to get married. The woman’s first marriage was also with a Hindu man. What procedures are required for them to get legally married?

Dear Client, You can get married under the Special Marriage Act, 1954. The couple must give a written Notice of Intended Marriage in the prescribed form to the Marriage Officer of the district where at least one of them has resided for a period of not less than thirty days immediately preceding the date on which the notice is given. Documents like proof of age, residence, and a copy of the divorce decree will be required. After filing the form, you will have to wait for 30 days to see if there is any objection to the marriage.
