Ancestral house on my land
My ancestral house is situated on land of which I am absolute owner by a family settlement. The house and land is in my physical possession. My contention is that other inheritors can only lay claim to their share of the proceeds of the sale of the building if it is sold but they can not use the building without my permission as legally it would amount to trespassing on my land which is underneath the house. The family settlement makes no mention of the house but is only with regard to the land underneath and appurtenant to the house of which land I am the absolute owner by the settlement. The house and land is in my physical possession. Is my contention legally correct?
Hello sir, i read your question you are saying that the property's partition is done already and you have been granted with your share of lands on which you have complete possession.
And rights no one other has the rights over that property you are legally authorized for that property and if someone tries to enter the property illegally he /she is liable for criminal trespass according to the question you asked.
