Am I entitled to my father’s pension after remarriage?
My father died while in service at a central university. He was divorced from his first wife via a Muslim divorce, which took place in three stages. They later went to a mediation center, and his first wife accepted the divorce, which included mehr, iddat money, an apartment, and Rs. 20,000 maintenance. However, she now denies the divorce, as my father did not get a court decree for the divorce. He remarried in 2019 in an Islamic ceremony but did not get his second marriage registered. Now, the university is refusing to give a pension to his current/second wife and is also refusing the pension to me, his daughter. Am I entitled to my father’s pension? I am 26 years old, unmarried, and I do not earn.
Ma’am, as an unmarried, dependent daughter, you may be entitled to your father's pension, but this depends on the university's pension rules. You should consult a lawyer to clarify your eligibility and address issues around your father's divorce and second marriage. For further legal assistance contact us on our helpline number.
