Can I annul underage marriage after turning legal age?
Hello sir, my name is Abhishek. I got married on 1st December 2021 to Simran. On the day of the marriage, she had completed 18 years of age, and I was 20. We had a court marriage. I had altered my date of birth in my Aadhaar card and PAN card to appear older. Now, it has become impossible for me to live with her, but she refuses to give me a divorce. We also have no children. I am now over 21 years old, and I want to cancel this marriage. I was told that I can file for annulment within two years of turning 21. Please advise me on what to do and whether any legal action can be taken against me.
Since you were underage at the time of marriage, the marriage can be annulled (cancelled) under the Prohibition of Child Marriage Act. Now that you are 21, you should file a petition in the family court within two years. No punishment applies if the marriage was between two consenting parties and no harm was done.
