Can I obtain a copy of the lawyer's notice regarding inheritance?
My father died while in service in 2019. He had another family, and I filed a case and obtained a judgment in 2022 stating that my mother, grandmother, and I are the only legal heirs. During the case, the VAO confirmed that no one else had applied for a legal heir certificate. However, now the other woman has sent a lawyer's notice to my father's office, claiming her children have the right to death benefits and a compassionate job. Can I obtain a copy of that lawyer's notice? Is there any law regarding the rights of legal heirs to obtain information about a deceased employee? Will the office stop processing the death benefits due to this notice? Please help.
You have the right to access the lawyer’s notice and request a copy from your father’s office. Legal heirs are entitled to know about any claim on the estate. The office may pause death benefits processing until the matter is resolved, but as per court judgment, you are the legal heir, and the other party's claim is invalid.
