Can landlord evict tenants while civil suit is pending?
In our apartment, 4 portions sold by builder and 4 owned by landlord. He is 76 years old. He gave it for rental to 4 family, in that 3 families are filed suit in civil court that metro water not given to bathroom and bore water is not usable. (its false claim, since other 4 house owners are happy to stay and no compliance received) Meanwhile they created nuisance for parking the vehicle and threatened other house owners that will stop metro water supply and Electric supply via his political influence. So, all house owners complained to landlord and he complained to police station. Because of this issue, landlord given 2 months’ notice to them to vacate. Their notice is about to end by august 2023. In this case, landlord terminate rent agreement while their suit and hearing is in process. If suppose, they won’t vacate, does landlord file eviction notice/process. Note: they did not pay rent past 3 months. However, rent agreement is not registered.
Yes, the landlord can start eviction proceedings if tenants haven’t paid rent and notice period has ended, even if a civil suit is pending. File for eviction in the civil court or under Rent Control Act if applicable. Though the agreement is not registered, other evidence (like rent receipts) can support the case.
