Can signed agreements establish legal possession of divided abadi land?
I want to know how we can legally take possession of this particular portion of land. During the division of the red-line abadi land, both parties gave a written statement on plain paper, duly signed by them, agreeing to give this particular portion of land to one party.
Dear Client, If signed by both parties along with witnesses, does hold evidentiary value and can support your claim to that portion of land, though it isn't a substitute for a registered document. To make possession legally secure, it's best to get a registered partition deed or family settlement drawn up based on that agreement, and get the mutation done in revenue records accordingly. If the other party refuses to cooperate now, you can file a suit for specific performance based on the signed agreement to enforce the division. I hope this answer helps, if you have any other query kindly do not hesitate to contact us. Thank-you.
The signed plain-paper agreement can be useful evidence of the parties’ understanding regarding the particular portion of land, but possession does not automatically become legally valid merely because the paper is signed. The validity depends on the land records, nature of the property, title, and applicable local law. You should preserve the signed paper and supporting documents and seek a declaration/partition or possession remedy before the appropriate authority/court, if necessary.
