Can society demand money before name transfer completes?
I have inherited a residential flat in New Mumbai. The name transfer is currently under process. I have cleared all dues, paid the society's transfer charges, and received acknowledgment receipts. The society was supposed to issue me the NOC next week, but the Secretary is now demanding a cheque of ₹10,000 as a lawyer’s fee, stating it's for redevelopment consultation. Most members have agreed to pay. Is this demand justified? Can I pay this amount after the name transfer?
The society cannot force you to pay redevelopment-related legal fees unless it is officially passed in a general body meeting. Since your flat transfer is unrelated to redevelopment, you may refuse payment for now and suggest paying only after you decide on redevelopment participation. Get this demand in writing if possible.
