Does misusing my PAN card for HRA claim constitute offense?

My previous tenant who gave me a lot of trouble while vacating my apartment in 2022 misused my pan card for hra claim on purpose. Does it come under criminal offense? How should I take action against him. I live out of country.

Misusing someone's PAN card for HRA (House Rent Allowance) claims without authorization is considered identity fraud and is a criminal offense under Indian law which is punishable with imprisonment up to 3-7 years and a fine. You can file a complaint with the local police and also lodge a complaint with the Income Tax Department, providing evidence of unauthorized usage. Feel free to contact us for any further queries.

Sir, your tenant's actions of misusing your PAN card for an HRA claim without your consent constitute criminal offenses such as identity theft and fraud. You should immediately file an FIR with the police report the incident to the Income Tax Department and seek legal action to protect your rights and seek compensation.
