How can I legally get my bank account unfreeze?
My Airtel Payments Bank account has been frozen by the Delhi Cyber Crime Cell since 2024 due to a cyber crime complaint. The disputed amount is only ₹184 out of a ₹5,000 transaction. I received the payment through a P2P cryptocurrency trade and was unaware that the sender's funds were allegedly linked to a disputed transaction. I have fully cooperated with the Investigating Officer and provided all the information and documents requested. Despite repeatedly contacting both the police and the bank, I have neither received any resolution nor been informed of any timeline for unfreezing my account. What legal remedies are available to get my bank account de-frozen? Can I file a writ petition or any other application before the appropriate court to seek relief?
Dear Client, You may file an application under Section 451 / 457 CrPC before the Magistrate for the release of frozen funds, especially when the disputed part is only ₹184. Or else, you can file a writ petition under Article 226 before the Delhi High Court, while pointing out unreasonable delay which, in turn, violates Article 21. Also, ask for a time bound finishing of the investigation or at least expedited completion. In parallel, send a legal notice to the IO and the bank, requesting a clear status update and the current stand on the matter. Generally, courts tend to look favorably towards releasing genuine funds when the applicant keeps cooperating properly, and when the disputed amount is rather small. Thank you for reaching out to Prime Legal.
If you have already cooperated with the investigation and the disputed amount is only ₹184, you may submit a written representation to the Investigating Officer requesting the de-freezing of your bank account. If no action is taken within a reasonable time, you may approach the appropriate court by filing a petition seeking directions to de-freeze the account. Keep all transaction records, communications, and supporting documents ready to strengthen your case. For further legal assistance contact us on our helpline number.
