How can I legally recover my money?
A girl, in the context of marriage, took a substantial amount of money from me in multiple installments, claiming that her mother was ill and that she needed to pay her college fees, among other reasons. All the payments were made through UPI or NEFT. Later, I found out that she was already married. I now want to know how I can recover my money, as she is not willing to issue any cheque or sign a promissory note. As evidence, apart from bank transaction records, I also have our chats and call recordings. How should I proceed, and what are my chances of recovery? Can she file any false allegations against me? I have never been physical with her and have rarely visited her home. She is from the North East and lives alone.
Dear Client, The Code of Civil Procedure 1908 enables you to file a civil recovery lawsuit through Section 9 for recovering funds which were acquired through unjust enrichment and misrepresentation. The law permits criminal charges under Section 318 of the Bharatiya Nyaya Sanhita 2023 when there is proof that money was obtained through deceptive means. The Bharatiya Sakshya Adhiniyam 2023 allows bank transfers and chat logs and phone call recordings as electronic evidence according to Sections 61 and 63. The process of recovering assets requires demonstration that someone induced the person who made the claim without receiving any gift. The person who makes false accusations can defend himself by keeping all evidence while avoiding direct encounters with others.
If she took money by falsely promising marriage while already being married, you may file a police complaint for cheating under Section 318 BNS, 2023. First, send a legal notice demanding refund.
