How to legally recover my security deposit?
I rented a flat for ₹18,000 per month and paid a two-month security deposit of ₹36,000. After staying in the flat for one month, I had to vacate it due to unavoidable family circumstances. The landlord initially informed me that he would return only one month's security deposit, claiming that I had vacated the property without giving prior notice. When I objected, he stated that he would deduct the entire security deposit. What legal remedies are available to recover my security deposit?
If your rental agreement does not permit forfeiture of the entire security deposit for leaving without notice, the landlord cannot arbitrarily retain the full amount. First, send a written demand requesting the refund along with the reasons why the deduction is unjustified. If the landlord still refuses, you may issue a legal notice and, if necessary, initiate appropriate legal proceedings to recover the refundable security deposit along with any other relief available under law.
