How to stop NBFC harassment and obtain pending NOC?
Hi Team, I had taken a personal loan of ₹36,000 from an NBFC loan app and provided one of my colleagues as a reference contact. Although I have already repaid the loan, the NBFC recovery agents are allegedly harassing me and my colleague by contacting him repeatedly. I am also claiming a refund of nearly ₹4 lakh from the NBFC. The recovery agents are using improper recovery methods and have stated that the refund will be made in cash. However, they claim that the cash refund has been handed over to another person whose name is similar to that of my colleague. They have further stated that receiving ₹2 lakh in cash would attract a penalty on both my PAN and my colleague’s PAN, and that the remaining ₹2 lakh would also result in penalties. The NBFC is also refusing to issue a No Objection Certificate (NOC). What legal remedies are available to stop the harassment, obtain the NOC, and resolve the refund dispute?
If the loan has been repaid and recovery agents are still harassing you or your reference contact, such conduct may be unlawful. Demand a written loan statement, repayment history, refund calculation, and NOC from the NBFC. Preserve all calls, messages, and payment records.
