Should I file an Original Application to quash departmental inquiry?

I am a Maharashtra State government employee. I am wrongly implicated in a crime by my superior and now I have to face departmental inquiry. I received a copy of the chargesheet and I have submitted my reply in response to the chargesheet. Should I file an Original Application (OA) for quashing the Departmental Inquiry (DE) against me as I have already suffered much hardships during the tenure of the superior responsible for the DE? Does filling an OA help in case of DE? Kindly guide.

You can file an Original Application (OA) to quash the departmental inquiry if you believe it is motivated or unjust. However, filing an OA might delay the inquiry process and may not always be successful unless there is solid evidence of malafide intentions or procedural errors in the inquiry. It is advised to consult a legal expert for a detailed strategy. For further legal assistance contact us on our helpline number.
