What action to take for illegal society garbage placement?
We are a housing cooperative society with 6 blocks and 48 flats. Each block has 4 floors with 2 flats on each floor. The Secretary and Board of Directors (BOD) created the society's garbage collection point directly below the bedroom of one of the blocks without discussing the decision in any meeting. The Secretary claims there is no alternate location and insists they can take such decisions without informing or seeking consent. All four members living on that side of the building raised written objections (two of them from abroad) during the construction, but the BOD ignored them. The garbage point has now become operational, and they are not responding to our letters. Moreover, they misbehave when we talk to them face-to-face. Since they are behaving this way, can I speak on behalf of my father, who is the official member while I am a resident? What can we do now? Do we need all four members from that side or all eight members of the block to take legal action? Two members are abroad and cannot be physically present. Is it worth taking legal action in this case, or should we go to the police?
You can raise the matter with the Registrar of Cooperative Societies or file a legal notice against the BOD. If needed, take help from a lawyer. You, as a resident and son of the member, can speak on behalf of your father. Even 2–3 residents can jointly raise a case and it is not necessary for all 8 to be present.
