What happens if home loan EMIs remain unpaid temporarily?
Dear Sir, my son obtained a loan for house renovation in 2018. The EMIs commenced in October 2019 and were paid regularly until March 2026. However, due to financial difficulties, he was unable to continue making payments, and currently two EMIs are overdue. On 23 May 2026, I emailed HDFC Bank requesting a moratorium of 3–4 months, but the request was not approved. Could you please advise after how many missed EMIs the bank can initiate action against the property? Also, what steps should we take at this stage to protect our interests and regularize the loan account? Kindly guide us.
Missing two EMIs does not usually result in immediate possession or sealing of the house. Banks generally follow a legal recovery process and provide notices before taking enforcement action. Your son should immediately contact the bank, explain the financial difficulty, and request restructuring, settlement, or temporary relief. Try to clear the overdue EMIs as soon as possible to avoid further recovery proceedings. For further legal assistance contact us on our helpline number.
