What legal action can I take for leakage and compensation?

There is a serious leakage issue in my flat due to the flat above mine. The flat owner and the society are not cooperative and are not willing to conduct the repairs. The flat owner blames the society, and vice versa. My only objective in fighting legally is to seek compensation for the damage and agony caused. Can I send a legal notice asking him to repair the damage and provide compensation? Additionally, if I file a civil suit, what is the probability of winning and the approximate time it will take for resolution? I reside in a different state and not in the flat where the issue is. Please advise accordingly.
