Can one co-owner stop the sale of jointly owned property?

We are five equal co-owners of my late father's property, which is an open plot measuring 21,000 sq. ft. Out of the five co-owners, four want to sell the property, but the fifth co-owner is opposing the sale. What legal remedies are available in this situation? If we file a partition suit in Mumbai, how long is the process likely to take?

If all co-owners do not agree to sell the property, it generally cannot be sold as a whole without the consent of every co-owner. The co-owners who wish to separate their shares may file a partition suit before the competent civil court. The time required depends on the facts of the case, the court's workload, and whether the matter is contested. For further legal assistance contact us on our helpline number.
