Why is mother deed important when buying divided property plots?
"A" has two plots in a single document and also has a document related to their mother for both plots. We are ready to buy the first plot from "A," but "A" is not willing to give me the mother's documents, as "A" has the second plot in the mother’s documents. Is it advisable to buy a single plot from the two plot documents without the mother’s documents? Also, if "A" had taken a loan/mortgage from a local financier before or on the day of our registration, will it create any legal issues?
It is risky to buy one plot without the original mother deed. The seller could use it for the second plot, risking legal disputes. Also, if the property is mortgaged, you could face issues later. Insist on a legal partition or consult a lawyer before proceeding. Title clarity is essential. For further legal assistance contact us on our helpline number.
