Can a government employee be suspended?
Respected Sir, I want to know whether a probationary government employee, who is assigned election duty as a Presiding Officer and fails to clear the mock poll, can be suspended by the Election Commission of India and face a departmental inquiry. In such a situation, can the government (employer) directly terminate the employee? Kindly help me clear my doubts regarding this matter. I look forward to your valuable reply. Regards.
Dear client, A probationary employee can be. Have to go through a departmental inquiry for being negligent while on election duty. The employer is not allowed to terminate the probationary employees' services without a good reason. The employer has to do a departmental inquiry and give the probationary employee a chance to explain themselves. This is only fair. The decision to terminate the employee's services depends on how serious the misconduct was and what the service rules say. If the probationary employee thinks the action taken against them is unfair they can take it to a service tribunal or a court to get it looked into. The probationary employee can challenge this action. Get a fair hearing. If you have any query please feel free to contact us.
A probationary employee can be suspended and face departmental inquiry for negligence during election duty. However, the employer cannot terminate services arbitrarily. Proper departmental inquiry and opportunity of hearing (natural justice) must be given. Termination depends on seriousness of misconduct and service rules. You can challenge unfair action before service tribunal or court. For further legal assistance contact us on our helpline number.
