Can a builder hold registry instead of my name for land?
I am going to purchase a 2 katha land (out of 5 katha) with someone who has already acquired 3 katha in the same plot. My point is: A builder has offered me to get 2 katha of land where he already has 3 katha. There will be a new building constructed up to 5 storeys. He told me to issue a cheque or payment directly to him, not to the real owner of the plot, because he wants the registry of the remaining 2 katha land in his name, not mine, as the land is undivided and the passes for map approval will not be granted for the entire 5 katha in this condition. A partnership agreement will be signed between me and him, stating that the 2 katha share is mine, and I have purchased and paid for it, but the registry will be in his name instead of mine.
The arrangement where the builder holds the registry in his name rather than yours could lead to complications in property rights. It is essential to have a clear, legally binding partnership agreement, but be cautious about the risks. Consult a property lawyer to ensure your interests are legally protected and avoid future disputes. For further legal assistance contact us on our helpline number.
