Can a woman claim share in fathers property?

Priya’s grandfather owned a house and shops. After his death, Priya’s grandmother made a will in favor of her three sons, including Priya’s father, Munish. After the grandmother's death, the property is jointly held by sons A, B, and C. Priya’s brother, Ajay, now has a share in the property as per Jamabandi, but Priya’s name is not mentioned. After marriage, Priya was unaware of the distribution. Her father is bedridden, and now Ajay has filed a partition suit against their uncles (B and C). Can Priya claim a share in the property, and can she file a case against her brother Ajay?

Priya can claim her share as a legal heir under Hindu Succession Law. Even if her name is not in Jamabandi, she still has rights in her father's share. She can intervene in the partition suit and also file a separate case if her brother Ajay tried to hide or misuse her share. For further legal assistance contact us on our helpline number.
