What legal actions can I take if agent refuses refund?

I signed an agreement for a land purchase in 2018 in Silchar and paid Rs. 2 lakh as an advance through NEFT to the concerned selling agent. However, the agent did not take any initiative to complete the final sale deed process or the formalities for transferring the land’s occupancy. Instead, he stopped answering phone calls and, at times, would only respond via WhatsApp, making false promises about returning the money and giving dates repeatedly. He claimed that the land was disputed. Since it was during the COVID period, I could not meet him in person. However, I had traveled from Guwahati to meet him earlier but could not meet him then. Now, after three years, he says the matter is time-barred and refuses to refund the money. When I visited him at his house in Silchar for the refund, he threatened to have me jailed for disturbing him, claiming that the police are in his favor. What should I do?

Sir, you can send a legal notice to the agent demanding the return of your money, citing breach of contract. If he does not respond, file a complaint with the Consumer Forum for a refund and compensation. You can also file a police complaint for threats or fraud. If necessary, approach the civil court to recovers the money, as the limitation period may be extended due to COVID.
