What should I do to claim succession for my aunt’s property?

My mother's sister passed away recently. Before her death, she wrote a will, which was registered in the local registered office in Andhra Pradesh. I have the original registered will, but the original document that links her to the property (which she inherited from her husband who died in 2012) is not available. Since they had no children, the possibility of getting a legal heir certificate is low. How can I claim succession for that house? The husband’s name is still listed in the EC, and I want to change it to mine. Can I sell the property with the original will?

If the property is in your mother’s sister’s name and she passed away without children, you may inherit the property through the will. If the legal heir certificate is difficult to obtain, you can proceed with the will to transfer the property. To change the name in the EC, you will need to approach the revenue department with the will for the mutation process. For further legal assistance contact us on our helpline number.
