What can I do about adverse remarks in my APAR?

Sir/Madam, I seek your advice on whether a subordinate can file a complaint before a Magistrate for adverse remarks in the APAR/OPAR regarding INTEGRITY, where the officer made adverse remarks stating "To Be Monitored" without following any procedure laid down in the CCS (Conduct Rules). Six years have passed, and the authorities have not initiated any action on the subordinate or the Reporting Officer regarding the representation. Can I submit an appeal before the Magistrate for suitable action against the Reporting Officer? Can the impugned adverse remarks be quashed by the court?

The subordinate can file a complaint before the Magistrate if adverse remarks were made improperly or without following due procedure. If the Reporting Officer violated rules, you may request the Magistrate to quash those remarks and take action. You can file an appeal if no action has been taken after six years.
