How do I recover my vehicle after police seizure?

My car met with an accident. Four people were on a scooter, riding on the wrong side, and suddenly came in front of my car. As a result, the police have seized my car, and the other party has filed an FIR against me. • How can I get my vehicle back? • What course of action should I take next, and how can I be freed from this situation? • Can the case be defended, and what legal action might I face from the court?

Dear Client, The car can be recovered from the police custody by filing an application u/s 451 of BNSS. This application must be supported by proof of ownership as well as a personal undertaking to present the vehicle whenever required. Since the factual scenario favors your position, preserve all the proof such as CCTV footage, photographs, witness statements etc., to be produced as evidence to prove your innocence in the matter. Connect with a lawyer as soon as possible to defend yourself in the proceeding, and file an application for anticipatory if the situation requires so. I hope this answer helps. In the accident case, file an application in court under Section 497 of Bhartiya Nagrik Suraksha Sanhita to get your car released. Hire a lawyer to gather evidence showing the scooter riders were on the wrong side. Your lawyer can help defend the case, seek bail if needed, and argue your innocence. If proven not at fault, serious legal consequences are unlikely. For further legal assistance contact us on our helpline number.
