Can consultancy misuse security cheque and send legal notice?

I had given a signed blank cheque as security to an overseas education consultancy on behalf of my wife. The consultancy presented the cheque, which got dishonoured. Due to continuous harassment by the consultancy agent, my wife’s education has also been terminated. The consultancy has now sent a legal notice regarding the cheque.

Dear client, as per your query, yes, an overseas education consultancy can be absolutely held liable for misusing a blank security cheque, and that, you have legal recourse to challenge the legal notice you received. The key is to prove that whether the cheque was for security and not for a present, legally enforceable debt when presented. I hope this answer was helpful. For further queries, please do not hesitate to contact us. Thank you.

If the cheque was given only as security and not for payment, you can legally challenge the cheque bounce case. Send a written reply to the legal notice within 15 days stating misuse of the cheque. Keep all proof and consult a lawyer to defend the case and take action against harassment. For further legal assistance contact us on our helpline number.
