How can I legally recover my money?
My relatives borrowed some money from me but they are not returning now. What should I do?
You should first send them a formal legal notice through a lawyer demanding repayment within a specific timeframe (usually 15-30 days), including details of the loan amount and any previous repayment requests. If they still don't repay after receiving the notice, you can file a civil suit for recovery of money in the appropriate court, but you'll need evidence of the loan like bank transfers, written agreements, witnesses, or any written communications acknowledging the debt.
For a loan given without any written documentation, you can file a civil suit for recovery of money under Order 37 of the Civil Procedure Code, 1908, though having witnesses or proof of transaction like bank transfers would strengthen your case. Alternatively, if there are any written acknowledgments or electronic communications about the loan, you can file a complaint under Section 138 of the Negotiable Instruments Act if they provided a cheque that bounced, or pursue mediation through Lok Adalat for faster resolution
Sir, firstly you should try to recover money amicably and if your relative does not respond to it then you can send legal notice with the help of an expert lawyer who will assist you in filing a case in court of law. For further legal assistance contact us on our helpline number.
