How to apply anticipatory bail for loan case?

I live in the Saharanpur district of Uttar Pradesh. I had taken a loan of ₹85,000 from Poonawalla Fincorp Limited. At that time, my financial condition was stable, and my business was running well. However, after some time, my business suffered a major loss, due to which I was unable to pay the installments on time. As a result, the company filed a case against me, and I received a summons (Case No. CS/269000/24) from the 8th Magistrate Court of Kolkata. Unfortunately, I was unable to respond to it in time, and now I have come to know that an arrest warrant has been issued against me, which is visible online. The police may come to arrest me at any time. I now wish to apply for anticipatory bail through you so that I may obtain relief from arrest. I am unable to travel to Kolkata myself and kindly request you to take up my case and provide me with legal assistance.

Dear Client, Anticipatory bail under section 438 of CrPC is not of use in the instant case, since arrest warrant has been issued by the magistrate court against you. Instead, apply for a regular bail under Section 70(2) before the court that issued the arrest warrant. I hope this answer helps. In case of future queries, please feel free to contact us. Thank you

Since a warrant is issued against you for loan default, you should immediately hire a lawyer to apply for anticipatory or regular bail. The lawyer can also ask the court to cancel the warrant. You can explain your financial troubles and even settle the loan amount to avoid arrest and resolve the case. For further legal assistance contact us on our helpline number.
