What can I do if bank sent notice to recover excess pension?
The bank has issued a notice for the recovery of an excess family pension amount of ₹12 lakh.
Recovery of excess pension amount is a valid transaction in India, but the Supreme Court has laid down certain instances wherein such recovery is impermissible on the grounds of its violation of Article 14 of the Constitution, such as Class III & IV employees, Retired employees or those due to retire within a year of recovery order, where excess paid for more than 5 years before the recovery order etc. the immediate steps to resort to now is to seek a detailed break up of the excess amount claimed, seek a confirmation regarding the authority of the Bank to recollect the sum and request that the due process of law be followed.
If the bank is asking to return ₹12 lakh as extra family pension, and the extra amount was received without your fault, you may not be legally bound to repay it. As per Supreme Court rulings, recovery in such cases can be challenged. It is best to consult a good lawyer and reply to the bank properly.
