Can I skip court hearing due to travel and work?
Sir/Madam, there is an ongoing case, and I am a witness in it. I attended one hearing and stated everything I remembered. Now, for the next hearing, I live in Pune and work in a retail shop. Attending the hearing is costly for me, as the journey expenses are high, and I would need 2-3 days off, but I do not get paid leave. Is there any way I can withdraw my name or get permission to be absent on that date?
If its a Civil suit then you can request the court under order 26, Rule 11 of the CPC to exempt yourself to present as a witness in the court. But in crminal cases it depends upon the facts and Jurisdiction of the case.
Sir, you can ask the court for permission to skip the hearing due to the cost and work issues. Write an application explaining your situation, like travel expenses and unpaid leave. In some cases, the court might allow you to give your statement via video call or a written affidavit. It’s a good idea to speak with the lawyer handling the case to help you submit this request.
