How can I quash FIR?
A is a Canadian citizen originally from Maharashtra, India, and currently living in Canada. B filed an FIR against A in 2018 under Sections 420, 467, 468, 471, and 420 r.w. 34 of the IPC and Section 67 of the Information Technology Act at a local police station in Maharashtra. The SP issued a lookout circular (LOC) against A in 2022. The investigating officer (IO) is still conducting the investigation, and a charge sheet has not been filed. A has submitted a written reply to the IO. A has interim bail from the district court, which specifies that if the IO deems arrest necessary, the IO must give 72 hours’ notice before arresting A. There is also a pending civil suit between A and B on the same matter since 2016. A, who has family ties and properties in India, would like to visit India and seeks to quash the LOC and FIR.
Sir, A can file a petition in the High Court to quash the FIR and the Look Out Circular (LOC). The court will assess whether the FIR and LOC are valid, considering any false or baseless allegations.
