What can I do if relative refuses to pay share?

I have coconut land with 85 trees and with fences installed 30 years back and adjacent to it is my aunt's empty land without fences. My land caretaker has been taking care of my land for 10yrs, my aunt initiated a fight with him in 2021 and I phoned her regarding this and said he is stealing her coconut in other land whenever he comes to my land and she insisted me that she will look after and pay the coconut amount share. I trusted and informed her to harvest coconut and sell it and pay money or keep in my storage room. The amount how much to pay etc was not discussed as I said that I would discuss face to face. But after a month I called her asking to meet but she gave reasons like unwell/not in the village etc likewise every month or two I called and the same repeated.it went on for 1.5 yrs, in Feb 2023 I met her face to face and she refused to pay any money. I filed a complaint to police they raised NCR instead FIR. Can I raise FIR on this based on call recordings? its worth 60K rs

You can file an FIR by submitting call recordings and evidence of communication. Since the amount is around ₹60,000, it's not a minor issue. Police filed an NCR earlier, but with proof, you can request the magistrate or senior officer to convert it into an FIR under cheating or misappropriation.
