What to do if false SC/ST case is filed?
I am currently under investigation in a false SC/ST Act case. The FIR includes the following sections: BNS 74, 79, 351(2), 352, 3(1)(द), and 3(1)(ध). The issue started over children playing in the society park. I am part of the 8-member society committee. A woman started complaining unnecessarily about the children in the society WhatsApp group. When four of us opposed her, she began abusing us. Two of us tried to stop her, but she shouted and made false allegations. Even though other society members calmed her down, she filed an FIR after three days. Now she is making new and fake allegations. Please guide me – what legal steps can I take?
Since you are facing false allegations, first apply for anticipatory bail to avoid arrest. Keep records of WhatsApp messages and witness statements to prove your innocence. You can file for FIR quashing in the High Court if it is clearly fake. Hire a good criminal lawyer to help you fight the case step by step.
