Can Indian–Spanish marriage be registered under Hindu Marriage Act?
My son recently married a Spanish woman, and they have come to India on vacation. They wish to register their marriage and obtain a marriage certificate under the Hindu Marriage Act.
Dear Client, If Hindu rituals were not performed, the marriage must be registered under the Special Marriage Act, 1954. It is a secular process, regardless of caste or religion, or place. Documents like proof of age, residence, etc will be required. If they wish to register the marriage abroad, then they can register it under the Foreign Marriages Act. I hope this answer helps. For any further queries, please do not hesitate to contact us. Thank you.
Dear Client, A marriage can be registered under the Hindu Marriage Act, only when both the parties fall under Section 2 of the Hindu Marriage Act. Your Son has already married a Spanish woman and they can only register their marriage in India under the Special Marriage Act. If they wish to register the marriage abroad, then they can register it under the Foreign Marriages Act, I hope this was helpful. For further queries, please do not hesitate to contact us. Thank you
If the marriage was performed according to Hindu rites and ceremonies, it can be registered under the Hindu Marriage Act, 1955 by applying to the local Marriage Registrar where the marriage was solemnized or where either spouse resides. The foreign spouse will need a passport, visa, birth certificate, marital status affidavit, and police verification. If Hindu rituals were not performed, the marriage must be registered under the Special Marriage Act, 1954 instead. For further legal assistance contact us on our helpline number.
