Can mutual divorce be stopped after receiving alimony and articles?
Sir, my husband filed a divorce case against me in 2020. On 17 October 2025, during the second motion of our mutual divorce case, I received the full alimony amount and all my articles. Now, only the collection of the divorce certificate is pending. I want to talk to my husband once before collecting the divorce certificate. Can I do so? If I do not go to collect the divorce certificate, will the mutual divorce still be considered complete, even though I have already received the full alimony and articles?
Dear client, as per your query, the legal position of India regarding to stopping of a mutual consent divorce after receiving alimony and articles is extremely complex, as it involves a conflict between a party's right to withdraw the consent and the court's stance against any kind of bad-faith tactics. I hope this answer was helpful. For further queries, please do not hesitate to Contact us. Thank you.
Once the second motion is completed and the court has passed the divorce decree, the mutual divorce is legally final. Collecting the divorce certificate is only a formality. Even if you do not go to collect it, the divorce will still remain valid. Taking alimony and articles shows consent. You may talk personally, but legally the divorce cannot be stopped now.
