How the amount of maintenance is decided?
I am a Hindu wife and I want to seek a mutual divorce with a one-time settlement. My husband is not likely to agree. I do not know my husband’s income. I was advised to send a legal notice for amicable settlement. But how can I find out his income before sending the notice and before deciding the alimony amount?
Dear client, It is illegal for you to independently obtain your husband's income information. However, the court may order him to provide his income, bank statements, and pay stubs if a divorce or maintenance case is filed. You can decide on alimony based on his disclosed income after sending a formal notice requesting an amicable settlement. If you have any query please feel free to contact us.
You cannot legally access your husband’s income details on your own. However, once a divorce or maintenance case is filed, the court can direct him to disclose his income, salary slips, and bank statements. You may first send a legal notice seeking amicable settlement and later decide alimony based on his disclosed income. For further legal assistance contact us on our helpline number.
