The Special Marriage Act mandates public notice for objections, but the Delhi High Court, in *Pranav Kumar Mishra & Anr V Govt of NCT Of Delhi*, recognized the right to privacy (Article 21), allowing couples to request waiver of notice to parents. To marry under SMA, parties submit ID, DOB, photos, affidavits, and residence proof. The procedure involves a 30-day "Notice of Intended Marriage" (Form A), after which the marriage is solemnized with three witnesses. One party must reside in the district for 30 days. Costs vary by location.

For court marriage without parents’ knowledge, you must file a notice with the marriage registrar. The notice is public but not sent to parents directly. You will need ID proof, address proof, and witnesses. After 30 days with no objections, the marriage is done. The cost of court marriage varies from state to state. It is advised to consult an expert matrimonial lawyer who will assist you with the smooth procedure of court marriage. For further legal assistance contact us on our helpline number.
