Which documents are required for foreign partner to perform court marriage?

I am an Indian citizen residing in Prayagraj, Uttar Pradesh, and I am planning to marry my fiancée, who is a German citizen, under the Special Marriage Act, 1954. The local Marriage Registrar has provided the required documents such as ID proof, birth certificate, address proof, affidavits, and witnesses. However, I need clarification regarding documents required from the foreign citizen. 1. Is any document from her home country confirming marital status required under Indian law? 2. Can a sworn affidavit of single status suffice instead of such documents? 3. Is a No Objection Certificate (NOC) required? If yes, what is the exact process to obtain it (embassy or home country authority)? 4. Is apostille or embassy verification mandatory? 5. Will the marriage be legally valid internationally, including in Germany? Kindly guide me on the correct legal requirements and process.

Dear client, When you get married under the Special Marriage Act, 1954 as a citizen you need to show your passport, birth certificate and proof that you are married or not. Sometimes a paper that says you are single is okay. It is better to get it checked by the embassy. It is an idea to get an Apostille so it is valid in other countries. If you do everything correctly and register it with the embassy your marriage will be legal in India and people in Germany will usually recognize it. The Special Marriage Act, 1954 makes sure that your marriage is valid and the embassy registration helps with that. If you have any query please feel free to contact us.

Under the Special Marriage Act, 1954, foreign citizen must provide passport, birth certificate, and proof of marital status. An affidavit of single status is often accepted but embassy verification is safer. Apostille is recommended for international validity. Marriage will be legally valid in India and generally recognized in Germany after proper embassy registration. For further legal assistance contact us on our helpline number.
