Why was a General category student allotted a BSG seat?
I am writing to seek urgent clarification regarding the seat allotment made to the student, ETI KHYATI SREE (NEET Rank – 23010, NEET Score – 531, OC Category, Female), during Phase 2 of the MBBS counseling for the academic year 2024–25. Based on the official Round 2 cutoff data, her merit score was well above the cutoff rank for a General (OC) Merit Quota seat at Kurnool Medical College. Despite her eligibility under the pure General Merit (OC) category, the allotment was made under the BSG Quota. This has resulted in the unnecessary use of a reserved BSG seat, which could have been allotted to another deserving BSG-category student.
- If a student of reserved category can secures a merit rank of a general category seat , he/she should be offered the choice of migration to General Seat, which has madated by courts rather than any rule. - The reason being that the reservation seat can be reallocated to the next reserved candidate, to ensure proper and efficient allocation of reserved seats. - To legally challenge this, a writ can be filed in the High Court and if a student has been double counted or the OC seat was withheld unlawfully or deliberately, can be challenged as well.
You can write to the counseling authority and the Director of Medical Education, attaching the official cutoff data to show the mistake. Request correction of the allotment so the seat is rightly counted under the General (OC) category. If not resolved, file a writ petition before the High Court for rectification.
