Can Section 269 case cause problems in going abroad?
I was booked under Section 269 during COVID times. I was in my car with my mask slightly down. I’m pretty sure there were no restrictions on being in a car (no full curfew). My stupid mistake – a policeman stopped me and made me sign some sheets (he said just say sorry). It later turned out to be an FIR. I came home unbothered. Cut to six months later, I got a summon. I showed up in virtual court and said sorry. No penalty was imposed. I just wanted to get rid of the case as quickly as possible. This was in 2021. I even asked the judge if this would create an issue in my PCC/record. She said no, just get the final judgment from the court and show it if asked. The policeman at the police station also said, “Nah sir,” at the time. Now, I wish to move abroad for education (M.S.), and I’ve read here and there (no reliable source) that it could create a problem for my PCC. Am I screwed? What should be my next course of action?
Dear Client, The issue will not cause trouble since the case was disposed off without a conviction. It is highly unlikely to affect you clearance certificate since only convictions or ongoing criminal proceedings are the kind of legal procedures that are detrimental for the clearance. To avoid any potential misunderstandings, preserve the proof of the no conviction disposition of the court. I hope this answer helps. In case of future queries, please feel free to contact us. Thank you.
You are not in trouble. Since your Section 269 case was closed without conviction or penalty, it will not affect your police clearance. Just collect the final court order showing the case is disposed of, and apply for your PCC. If needed, get a "no conviction" letter from the court to show authorities.
