Can I apply for Khedut certificate as an OCI holder?
I am US Citizen and an OCI holder. I am inheriting farmland in Gujarat and wanted to ask if i can apply for Khedut certificate? Am I eligible for that? Are there benefits in getting their certificate? In future, my father in law might transfer his farmland to mine as well, any benefit during that? Thanks.
Under FEMA regulations, Overseas Citizen of India (OCI) cardholders are legally barred from owning agricultural land or obtaining farmer (Khedut) certificates in India, as these rights are exclusively reserved for Indian citizens. Any intended agricultural land transfer from relatives would require either your return to Indian citizenship by renouncing US citizenship, or identification of an eligible Indian citizen as the transferee.
An OCI cardholder cannot own agricultural land in India, and consequently cannot obtain a Khedut (farmer) certificate, as these rights are restricted to Indian citizens only. For any future transfers of agricultural land from your father-in-law, you would need to either renounce your US citizenship and obtain Indian citizenship to own it, or have it transferred to an eligible Indian citizen, as OCIs are prohibited from acquiring agricultural property under FEMA regulations.
