Can I sue seller for hiding suicide in flat?

We bought a flat, but neighbors say there was a suicide there 10 years ago. The seller didn’t inform us and claims it’s just a rumor. The title and documents are clear, and there’s no legal case pending. However, we are afraid to live here. Can I take legal action against the seller? How can I check if a crime really happened there? Can the seller be made to take the house back and refund us?

In India, a suicide in a flat is not legally considered a defect or “material fact.” Sellers need not disclose it unless asked and they lie. Legal action is possible only if the buyer proves the seller knew, was asked, and misled them. Though socially sensitive, it’s not legally actionable unless deception or misrepresentation is established. For further legal assistance contact us on our helpline number.
