Can we claim property after signing no-interest document?
My mother and her sister signed a document 31 years ago, after the death of my maternal grandfather, stating that they are not interested in the property. Now, we want to claim a share in the property. Can we still claim a share? If yes, how?
If someone gave up rights to ancestral property 31 years ago through an NOC and the property stayed in settled possession, any new claim now is legally too late. The 12-year limit under the Limitation Act applies. Also, waiver, estoppel, and acquiescence prevent reopening the issue. Courts usually reject such delayed claims at the very start. It is advised to consult an expert civil lawyer who will assist you with the best course of action. For further legal assistance contact us on our helpline number.
