How can I enforce an unregistered notarized property division agreement?

Hi, how can i get the court to enforce an unregistered property division agreement made in the year 2013 between myself and my brother? It is a notarized document which has been signed by witnesses. And also includes details of part payment received by my brother for a house i am trying to get transferred to my name. After signing the agreement he refuses to accept the payment and refuses to transfer the house in my name. Thanks for your help.

Sir, while the notarized document might not transfer property rights immediately due to the lack of registration but it is still legally valid as evidence in a dispute. You can file a suit for specific performance in court to enforce the agreement and compel your brother to transfer the house to your name. It is advised to consult an expert lawyer who will assist you with the best course of action. For further legal assistance contact us on our helpline number.
