How can I retain property ownership despite court judgment favoring husband?
My husband purchased a house in my name. His job is in the Gulf, and the payment of 1 crore was made from his personal NRE account, while the remaining 15 lakh was paid from both our joint NRO account directly to the builder. I am a housewife and have no income source. In 2022, I received an IT notice regarding the property purchase. I declared that I am a housewife and did not make any payment towards the purchase of this house. My husband, who is an NRI, purchased the property and used my name. All payments to the builder were made from his income. During the registration process, my husband was not present in India, so I went and registered the property in my name. The IT department accepted my declaration and confirmed that no tax would be applied since I had no involvement in the payment. My husband has all the transaction documents and a duly signed IT declaration by me, which was accepted by the IT department. Additionally, he filed an ownership declaration and a permanent injunction suit in the family court under Section 7. The sale deed is in my name only, but all documents have been submitted to the court. The court judgment may favor my husband. How can I fight this case to retain ownership of the property?
