How to legally inherit property after a relative’s death?

My mother had a second marriage and she passed away in 2018. My father (my mother’s second husband) passed away in 2021, and my stepbrother passed away in 2022. My stepbrother had no siblings except me. His grandmother, who passed away in 2012, gifted her property to him in 2011. Using that gifted property, he entered into a joint venture with a property builder and acquired two flats. Now, since my mother, father (second husband), and unmarried stepbrother have all passed away, can I claim ownership of the two flats that are in my stepbrother’s name?

Since your stepbrother had no siblings and has passed away unmarried, you may have a claim to his property as his legal heir, depending on the inheritance laws applicable (like Hindu Succession Act). Consulting a property or succession lawyer will clarify your rights and the process to claim ownership of the flats. For further legal assistance, you can contact us on our helpline number.
