What to do if someone violates court stay on land?
My father bought a piece of land from his elder brother, Mr. X, in 2006. In 2011, Mr. X planted 40 sagwan (teak) trees on that land. When my father objected, Mr. X claimed he had planted the trees with the understanding that they would not be cut. Later, in 2011, my father paid ₹6,000 to Mr. X and purchased the rights to those trees. Now, Mr. X is trying to cut down the trees. A stay order has already been passed by the court on this land. The trees have been a matter of dispute for the last 5 to 6 years. Last year, Mr. X even attempted to kill my father in Amritsar, and a complaint has been filed at the Amritsar police station. Now Mr. X has again gone to Gonda to cut down the trees, while we are in Amritsar due to our studies and work. What can I do in this situation?
Since there’s a court stay order, immediately give a written complaint to local police and revenue officials in Gonda to stop tree cutting. If Mr. X cuts trees, file a contempt of court case.
